Varacchi Celebrated Memorial Day With A Literal Hawk

I spent Sunday of Memorial Day weekend in Belmar, and as I was heading home driving south down Route 35, something on the side of the road caught my eye. I quickly asked my wife "was that a hawk?" but she didn't catch it. I was certain enough that I actually turned around at the next chance, and pulled into the parking lot of the business where I saw it.

Obviously in that pic you can only see a small blur, so I tried to zoom in. Forgive the less-than-best quality, the only camera I had on me was my iPhone.

I'm no ornithologist, does anyone know if that's actually a hawk? Or is it some kind of falcon? What's the difference between a hawk and a falcon anyway?
