The victim of a fatal hit-and-run on Christmas morning in Toms River was actually hit by an NJ Transit Bus making a turn onto Herflicker Boulevard, according to the Ocean County Prosecutors Office.

The day after the accident occurred Toms River Police along with investigators from the Ocean County Prosecutors Office returned to the scene of the accident and spoke with the driver of an NJ Transit Bus on duty that day.

Wilford Anderson Jr., 60, of Sicklerville who was driving a different bus on December 26, told investigators a man tried waving him down to get onto the bus, so the driver stopped the bus but signaled to Elliott he wasn't permitted to board.

The driver told investigators he didn't see Elliott and thought he had crossed passed his bus safely to the other side as he turned onto Herflicker Boulevard as did his passengers.

Detectives from the Prosecutors Office found video showing the bus hitting Elliott as he was crossing the street.

The accident remains under investigation with these preliminary findings and no charges are reported against the driver of the bus.
