A South Toms River woman is in critical condition after being hit by a car around 7:30 pm Thursday night between Route 37 and Hawser Place in Toms River.

Investigators say the dog 39-year old Lovell Smith was sitting at the Pine Rest Motel for a friend ran onto Route 37 where it was hit by a 2006 GMC Envoy.

While the driver stopped to check on the dog, Smith was already on her way to the scene.

She was then hit by the driver of a 2003 Ford Explorer, 53-year old Gary Meseroll of Toms River, who "had no opportunity to avoid the impact with the woman," according to Township Police.

Police added that Meseroll didn't have any signs indicating he was impaired and say charges aren't likely to be filed against him.

Smith was medevacked to Jersey Shore Medical Center and the condition of the dog is unknown at this time.

The public is reminded that criminal charges are accusations only. Every criminal defendant is presumed innocent unless and until proven guilty in court.
